Welcome to Beez Works LLC. These Terms and Conditions ("Terms") govern your use of our website located at www.beezwrx.com (the "Site") and any services, communications, or text messaging programs provided by Beez Works LLC ("we," "our," or "us").

By accessing or using our Site, booking our services, or opting in to our text messaging program, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Site or use our services.

1. Services & Estimates

  • Scope of Work: Beez Works LLC provides residential and commercial landscaping, turf management, property maintenance, and seasonal snow plowing services.

  • Estimates & Pricing: All quotes and estimates provided are valid for 30 days unless otherwise specified. Pricing may be adjusted if the scope of work changes or if site conditions differ from those initially assessed.

  • Service Agreements: Specific service plans, schedules, and payment terms may be further detailed in individual client service contracts or invoices.

2. SMS/MMS Mobile Marketing & Operational Messaging Terms

By opting in to receive text messages from Beez Works LLC, you agree to the following terms regarding our mobile messaging program:

  • Program Description: We send operational notifications (such as service updates, routing alerts, estimates, and invoices) as well as promotional and marketing messages (such as seasonal service reminders and special offers) via SMS and MMS.

  • Consent is Not a Condition of Purchase: Consenting to receive text messages is not a condition of purchasing any property maintenance, landscaping, or snow plowing services from Beez Works LLC.

  • Opt-Out Instructions: You can cancel or opt out of the SMS service at any time. Text the keyword "STOP" to the number from which you received the message. You will receive a one-time confirmation message verifying that you have been unsubscribed, and you will receive no further text messages unless you re-opt in.

  • Help: For assistance, reply "HELP" to any message, or contact our customer support at [Insert Business Email/Phone].

  • Carrier Liability: Mobile carriers (including AT&T, T-Mobile, Verizon, Sprint, etc.) are not liable for delayed or undelivered messages.

  • Cost & Frequency: Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies based on your service schedule and promotional campaigns. Contact your wireless provider for questions about your specific text or data plan.

3. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Beez Works LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. User Representations

By using the Site or our services, you represent and warrant that:

  • You have the legal capacity and you agree to comply with these Terms and Conditions.

  • You are at least 18 years of age (or have parental/guardian consent where applicable).

  • You will not use the Site or our messaging program for any illegal or unauthorized purpose.

  • Your use of the Site or our services will not violate any applicable law or regulation.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Beez Works LLC, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site or services; (ii) any conduct or content of any third party on the Site; or (iii) unauthorized access, use, or alteration of your transmissions or content.

6. Indemnification

You agree to defend, indemnify, and hold harmless Beez Works LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) resulting from or arising out of your use and access of the Site and services, or a breach of these Terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Erie County or the State of New York.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
